Welcome to Smarty Voice Notes. These Terms govern your use of our voice recording, transcription, and AI-powered note processing application.

1. Acceptance of Terms

By accessing or using Smarty Voice Notes, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the app.

2. Description of Service

Smarty Voice Notes is a voice recording and transcription application that allows you to:

• Record audio notes and import audio files
• Transcribe recordings to text using AI, with support for 19+ languages
• Identify multiple speakers in a recording (speaker diarization)
• Generate AI-powered summaries, key highlights, and action items
• Rewrite transcripts in different styles (professional, academic, casual, and more)
• Chat with your notes using AI (Premium)
• Store and manage your recordings securely

3. User Accounts

• You must create an account to use certain features
• You are responsible for maintaining the security of your account
• You must provide accurate information when creating your account
• You may not share your account credentials with others

4. Subscription and Payments

• Some features require a paid subscription (Premium)
• Subscriptions are billed monthly or yearly as selected
• You can manage or cancel your subscription at any time
• Refunds are handled according to the App Store's refund policy

5. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Record conversations without proper consent where required by law
• Upload content that infringes on others' rights
• Attempt to reverse engineer or hack the application
• Use the service to harass, abuse, or harm others

6. Content Ownership

• You retain ownership of your recordings and transcriptions
• You grant us a license to process your content to provide our services
• We do not claim ownership of your content

7. AI Features and Processing

Smarty Voice Notes uses artificial intelligence to power several core features. By using the app, you consent to your audio and text content being processed by these AI systems as described below.

7.1 Transcription

• Your audio recordings are sent to OpenAI's Whisper API for speech-to-text transcription. Whisper supports automatic language detection across 19+ languages.
• For recordings with multiple speakers, we use OpenAI's speaker diarization model to identify and label individual speakers in the transcript.
• Transcriptions are returned as raw text and stored securely in your account. No audio is retained by our AI providers beyond the duration of the API call.
• Transcription accuracy depends on audio quality, background noise, accents, and the clarity of speech. We do not guarantee error-free output.

7.2 AI-Powered Rewriting and Summarization

• After transcription, you may request AI processing via OpenAI's GPT-4o mini to generate: a cleaned-up formalized version of your transcript, a condensed summary, key highlight bullet points, and extracted action items.
• You can choose from multiple rewrite styles including simple, professional, academic, casual, formal, or a custom style you define yourself.
• In multi-speaker transcripts, the AI attributes statements and action items to individual speakers by name.
• AI-generated rewrites, summaries, and action items may contain inaccuracies, omissions, or misattributions. You are responsible for reviewing all AI-generated output before relying on it.

7.3 Chat with Notes

• Premium users may interact with their transcriptions using a conversational AI feature powered by OpenAI's GPT-4o mini. This allows you to ask questions about the content of a specific recording.
• Your transcription content and chat messages are sent to OpenAI for processing. Conversation history within a session is used as context to generate responses.

7.4 AI Usage Consent and Limitations

• We do not use your recordings, transcriptions, or personal data to train AI models.
• Audio and text data sent to OpenAI is subject to OpenAI's privacy policy. We use their API under a data processing agreement that prohibits training on customer data.
• You are solely responsible for ensuring you have the legal right and any required consent from all parties before recording conversations and submitting them for AI processing.
• We are not liable for decisions made based on AI-generated content. Always verify critical information independently.

8. Limitation of Liability

To the maximum extent permitted by law:

• The service is provided "as is" without warranties
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid for the service

9. Account Termination

• You may delete your account at any time through the app
• We may terminate accounts that violate these Terms
• Upon termination, your data will be deleted

10. Changes to Terms

We may update these Terms from time to time. Continued use of the app after changes constitutes acceptance of the new Terms.
